U.S. immigration law allows certain noncitizens who are employment-based immigrants to become lawful permanent residents (get a Green Card). One employment-based (EB) “preference immigrant” category includes noncitizens who have invested or are actively in the process of investing $1,050,000 (or $800,000 in a targeted employment area or infrastructure project) in a new commercial enterprise that will benefit the U.S. economy and create at least 10 full-time positions for qualifying employees. These noncitizens are also called “EB-5 immigrant investors” because they are in the employment-based fifth preference visa category.   • Be a national of a country with which the United States maintains a treaty of commerce and navigation;
  • Have invested, or be actively in the process of investing, a substantial amount of capital in a bona fide enterprise in the United States; and
  • Be seeking to enter the United States solely to develop and direct the investment enterprise. This is established by showing at least 50% ownership of the enterprise or possession of operational control through a managerial position or other corporate device.
